Missing Elements in New Legal Framework for Migrants Workers in Romania

Several revisions in legislation on migrant workers' rights have been recently adopted in Romania which also concern posted workers from non-EU Member States. Working conditions are not improving at all as the changes are firstly of an administrative nature (new type of working permit and simplification of procedures for employers) and secondly concern the introduction of the possibility to extend posting contracts from 1 to 2 years. This means that posted workers from third countries will continue to have less rights than posted workers from EU countries.

ADO SAH ROM, SOLIDAR's Romanian member conclude that the current economic situation in Romania is making the problem of immigration far less important for all stakeholders and allows interested parties to promote bad working and living conditions for the posted workers from third countries. They hope that trade unions will have the possibil ity to discuss the drafts of the amended laws in tripartite structures with employers and the government and that the Romanian Parliament will find time and energy to put these issues again higher on their agenda and priority lists.Read a
